ZurMed Corp (“ZurMed”, “we” or “us”) is committed to respecting the privacy rights of our customers, visitors, and other users of zurmed.com (the “Site”) and applications, provided by ZurMed (“Services”). As part of the normal operation of ZurMed we collect and disclose information about you. We are committed to respecting the privacy rights of our customers, visitors and users. This Privacy Policy (“Privacy Policy”) describes the information we collect about you and what may happen to that information. 
This Privacy Policy is only applicable to our Site and not to any other website that you may be able to access from the Site or any website of our business partners, which may have data collection, storage, and use practices and policies that differ materially from this Privacy Statement.   
Remember that your use of the Services is at all times subject to the Agreement (as the term “Agreement” is defined in our Terms of Use), which incorporates this Privacy Policy.


BY USING THE SITE, SERVICES AND/OR BY REGISTERING WITH US, YOU ACCEPT THE PRACTICES AND POLICIES OUTLINED HEREIN, AND YOU HEREBY AGREE AND CONSENT THAT WE MAY TRACK, COLLECT, USE, AND SHARE YOUR INFORMATION IN THE MANNER SET FORTH HEREIN.  IF YOU ARE REGISTERING AN ACCOUNT OR USING OUR SERVICES ON BEHALF OF AN INDIVIDUAL OR ENTITY OTHER THAN YOURSELF, YOU REORESENT THAT YOU ARE AUTHORIZED BY SUCH INDIVIDUAL OR ENTITY TO ACCEPT THIS PRIVACY STATEMENT ON SUCH INDIVIDUAL’S OR ENTITY’S BEHALF.

  1. Information We Collect

To match you with a doctor, either by telephone or via our online search pages, we require you to provide us with your full name, contact information such as address, telephone number and e-mail address ("personally identifiable information"), and medical need. In the course of using our service and/or the site, we automatically track certain information about you. This information includes the URL that you just came from (whether this URL is on our site or not), which URL you go to next (whether this URL is on our site or not), what browser you are using, and your IP address.
Certain areas of the Site or certain Services will require us to collect information that personally identifies you (hereinafter “Personal Information”).  Personal Information which may be required from you includes following categories:
- contact data such as e-mail address, telephone number;
- demographic data such as gender, date of birth, and zip code;
- insurance data such as your insurance carrier and plan;
- medical data such as previous doctors and healthcare providers, medical history, and other medical and health information you choose to share.  If you send personal correspondence to us, such as an e-mail, letter or survey, we may collect such information into a file specific to you.

  1. HIPAA and PHI

Under a federal law called the Health Insurance Portability and Accountability Act (“HIPAA”), some demographic, health and/or health-related information that ZurMed collects as part of providing the Services may be considered “protected health information” or “PHI.” Specifically, when ZurMed receives identifiable information about you from or on behalf of your Healthcare Providers, this information is considered PHI.
HIPAA provides specific protections for the privacy and security of PHI and restricts how PHI is used and disclosed. ZurMed may only use and disclose your PHI in the ways permitted by your Healthcare Provider(s).

  1. How We Collect Information

We collect information (including Personal Information and Traffic Data) when you use and interact with the Services, and in some cases from third party sources. Such means of collection include:
- when you use the Services’ interactive tools and services, such as searching for Healthcare Providers, searching for available appointments with Healthcare Providers prior to Healthcare Provider appointments;
- when you voluntarily provide information in free-form text boxes through the Services or through responses to surveys, questionnaires and the like;
- if you download and install certain applications and software we make available, we may receive and collect information transmitted from your computing device for the purpose of providing you the relevant Services, such as information regarding when you are logged on and available to receive updates or alert notices;
- if you download our mobile application or use a location-enabled browser, we may receive information about your location and mobile device, as applicable;
- through cookies, web beacons, analytics services and other tracking technology (collectively, “Tracking Tools”), as described below; and
- when you use the “Contact Us” function on the Site, send us an email or otherwise contact us.

  1. Tracking Tools

We may use tools outlined below in order to provide our Services to, advertise to, and to better understand users.
- Cookies: “Cookies” are small computer files transferred to your computing device that contain information such as user ID, user preferences, lists of pages visited and activities conducted while using the Services. We use cookies to improve or tailor the Services, customize advertisements by tracking navigation habits, measuring performance, and storing authentication status so re-entering credentials is not required, customize user experiences with the Services, and for analytics and fraud prevention.
- Web beacons: “Web Beacons” (a.k.a. clear GIFs or pixel tags) are tiny graphic image files embedded in a web page or email that may be used to collect information about the use of our Services, the websites of selected advertisers and the emails, special promotions or newsletters that we send. The information collected by Web Beacons allows us to analyze how many people are using the Services.
- Web service analytics: We may use third-party analytics services in connection with the Services, including, for example, to register mouse clicks, mouse movements, scrolling activity and text typed into the Site. We use the information collected from these services to help make the Services easier to use. These analytics services generally do not collect Personal Information unless you voluntarily provide it and generally do not track your browsing habits across web services that do not use their services.
- Mobile device identifiers: As with other Tracking Tools, mobile device identifiers help ZurMed learn more about our users’ demographics and internet behaviors in order to personalize and improve the Services. Mobile device identifiers are data stored on mobile devices that may track mobile device and data and activities occurring on and through it, as well as the applications installed on it.
Our Use of Your Information

We use the information you provide to return to you a list of member doctors from which you may choose your new doctor. Additionally, we use personally identifiable information about you internally to improve our marketing and promotional efforts, to statistically analyze site usage, to improve our content and product offerings and to customize our site's content and layout. We believe these uses allow us to improve our site and better tailor it to meet your needs.
All information, either provided to us or if contained within a customer survey, is deemed the property of ZurMed upon receipt. Correspondence/information submitted to ZurMed may be used in whole or in part, without restriction, and in any medium, including but not limited to publicly displayed medium, by ZurMed in its sole and absolute discretion for any purpose, including marketing; direct tailored advertisement; personalized emails pertaining to your health interests including news, announcements, reminders, and opportunities; and educational purposes. At no time will ZurMed use, reproduce, or publish any correspondence with personally identifiable information.
If you request to receive information regarding our member doctors, products, services, and/or promotional campaigns via e-mail and/or text message, you may receive a follow-up e-mail, telephone call, mail, facsimile and/or text message from ZurMed. Standard text messaging rates and/or cell phone airtime rates may apply. If at anytime you would like to unsubscribe from future communications from ZurMed, please contact us.

  1. Our Disclosure of Your Information

We reserve the right to use and to disclose to third parties all of the information that we collect from you over the telephone or online, in any way and for any purpose. Once you have selected a new doctor, either by telephone or through the use of the Site, we will share your personally identifiable information with your doctor. If you request to be matched with a doctor for a specific medical product or brand, we may share your personally identifiable information with the company manufacturing the product.  In addition, ZurMed cooperates with all law enforcement inquires. Therefore, local, state and federal law enforcement can request your name, street address, city, state, zip code, phone number, and e-mail address. Due to the existing regulatory environment, we may be forced to disclose information to the government or third parties under certain circumstances, or third parties may unlawfully intercept or access transmissions or private communications. Further,  we can disclose any information about you to law enforcement or other government officials as we, in our sole discretion, believe necessary or appropriate. Therefore, although we use industry-standard practices to protect your privacy, we do not promise, and you should not expect, that your personally identifiable information or private communications will remain private.

  1. Your Privacy Rights

You can always opt not to disclose information to us, but keep in mind some information may be needed to register with us or to take advantage of some of our features.
If you are a registered user of the Services, you can modify certain Personal Information or account information by logging in and accessing your account. The information you can view, update, and delete may change as the Services change.
If you wish to close your account, please contact us. ZurMed will use reasonable efforts to promptly delete your account and the related information. Please note, however, that ZurMed reserves the right to retain information from closed accounts, including to comply with law, prevent fraud, resolve disputes, enforce the Agreement and take other actions permitted by law.
You must promptly notify us if any of your account data is lost, stolen or used without permission.

  1. How Long We Retain Your Information


We retain Personal Information about you for as long as you have an open account with us or as otherwise necessary to provide you Services. In some cases we retain Personal Information for longer, if doing so is necessary to comply with our legal obligations, resolve disputes or collect fees owed, prevent fraud, enforce the Agreement, or as otherwise permitted or required by applicable law, rule or regulation. Afterwards, we retain some information in a depersonalized or aggregated form but not in a way that would identify you personally.

  1. Changes to Privacy Policy

The terms of this privacy policy will govern the use and any information collected while it is in place. ZurMed reserves the right to change this Privacy Policy at any time, so please re-visit this page as often as you wish. In case of any material change, we will change the date in this Privacy Policy. Changes to this Privacy Policy are effective as of the stated date and your continued use of this site on or after that date will constitute acceptance of, and agreement to be bound by, those changes.

  1. Children’s Online Privacy Protection Act

We do not collect information from children under the age of 13 years in compliance with the Children’s Online Privacy Protection Act ( “COPPA”). If you are a parent or legal guardian of a minor child, you may, use services on behalf of your minor child, in compliance with the Terms of Use. Any information provided by you on behalf of your minor child will be deemed Personal Information as provided herein.
COPPA severely restricts what information can be collected from children under the age of 13. As such, children under the age of 13 in the United States are prohibited from using our services, which are not directed at children. We do not knowingly collect any information from individuals under the age of 13. If it is discovered that information was submitted to us by an individual under the age of 13 years, we will use such information for the sole reason of responding directly to that child or parent/legal guardian to inform them that they cannot use the services. Subsequently, we will delete that information from our servers.

  1. Security

ZurMed uses industry-standard efforts to safeguard the confidentiality of your personally identifiable information. Although we make good faith efforts to store Personal Information in a secure operating environment that is not open to the public, we do not and cannot guarantee the security of your Personal Information.
It is the users’ responsibility to safeguard the information included in the correspondence delivered by us to users. We are not responsible and carry no liability for correspondence sent from us to users including but not limited to appointment confirmations, offers, advertisement, and/or informational notifications that may be accessed by third parties, once same is delivered to users.
